Any individual or a business entity engaged in a manufacturing activity, hotels, restaurant, hospital or a clinic in Delhi is required to have a DPCC Registration or DPCC license to make sure that the particular activity is compliant with the Delhi Pollution Control Committee (DPCC) and the air or water pollution by the business activity is within the limits set by the Delhi Pollution Control Committee.

The consent certificate from the Delhi Pollution Control Committee (DPCC) is also called a DPCC license or DPCC NOC. The DPCC certificate for white category of business is called as the DPCC Registration while the DPCC Certificate for Green and Orange category of Business activity is called as the DPCC Consent. DPCC consent is of two types. The Consent to Establish (CTE) certificate is issued for establishing a business, i.e construction of the factory premises, installation of the machinery etc. The Consent to Operate (CTO) certificate is issued after the Consent to Establish (CTE) certificate and when the business becomes fully operational.

The validity of the DPCC Registration, for white category of business is 7 years and the validity of Consent to Establish (CTE) certificate, for green and orange business category, is generally one year or till the construction of the factory premises and installation of the machinery. The validity of the Consent to Operate (CTO) certificate is up to ten years for green category and up to five years for orange category of business activities. 

Any individual or a business entity engaged in the manufacturing of articles in a factory premises, having hospitals, hotels, restaurants and any other health care establishment, is required to have a Delhi Pollution Control Certificate (DPCC) certificate.

OCMMS means Online Consent Management and Monitoring System of the DPCC, wherein the applications for DPCC license or the certificate are submitted and the certificate is issued. CMC is the Consent Management Cell of the DPCC, wherein the Delhi Region is divided into various zones, each with a separate Consent Management Cell.

The applicant is required to submit initial details and create a login id and password on the website of Delhi Pollution Control Committee, After this, the applicant needs to submit all the details of the business, Company name, address of business, nature of work, usage and wastage of water, any kind of emission, details of the DG Set, Boiler, Oven etc. After that the fee is deposited online. The Registration for White category of business is issued and for green and orange category, the application is automatically forwarded to the concerned officer of the Delhi Pollution Control Committee. The concerned officer may visit the applicant’s factory premises or the hotel, restaurant, hospital etc and issue some clarifications. Once the clarification raised by the concerned authority are suitably answered, the Certificate is issued.

The one-time Government fee for white category of business activity is Rs.10,000. The Government fee for green and Orange categories depend on a letter issued by the Chartered Accountant, stating the total project cost of the business, the cost it incurred in setting up a business enterprise. For Boiler, Oil and Grease Trap, Effluent Treatment Plant (ETP) or a Sewage Treatment Plant (STP), the laboratory testing fee ranges between Rs.5,000 to Rs.10,000.

As per the DPCC notification, no business activity can be performed in the residential area. The white category of business, along with the hotels, restaurants and health care establishments can be set up in the commercial areas also. The manufacturing business activities under green and orange categories can only be performed in an Industrial area. 

About Delhi Pollution Control Committee (DPCC)

The Indian Parliament, in 1974, enacted a law to prevent and control the pollution in the water. This law is known as Water (Prevention and Control of Pollution) Act, 1974. In the year 1981, a similar law was passed to control the pollution in Air and is known as Air (Prevention and control of Pollution) Act, 1981. The Central Pollution Control Board (CPCB), a statutory organization, came into existence in September 1974. All the powers and functions of the Central Pollution Control Board (CPCB) are envisaged in both the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and control of Pollution) Act, 1981. Section 4 of the Water (Prevention and control of Pollution) Act, 1974 and section 6 of the Air (Prevention and Control of Pollution) Act, 1981 empowers the Central Pollution Control Board to act as State Pollution Control Board for all the Union Territories of the Union of India.

In March 1991, all its powers and functions of the Central Pollution Control Board (CPCB) for the Union Territory of Delhi were transferred to a committee of officials as per the specification of the Government of India. This committee of officials constituted by the Central Pollution Control Board is called as the Delhi Pollution Control Committee (DPCC).
