About Delhi Pollution Control Committee (DPCC)

The Indian Parliament, in 1974, enacted a law to prevent and control the pollution in the water. This law is known as Water (Prevention and Control of Pollution) Act, 1974. In the year 1981, a similar law was passed to control the pollution in Air and is known as Air (Prevention and control of Pollution) Act, 1981. The Central Pollution Control Board (CPCB), a statutory organization, came into existence in September 1974. All the powers and functions of the Central Pollution Control Board (CPCB) are envisaged in both the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and control of Pollution) Act, 1981. Section 4 of the Water (Prevention and control of Pollution) Act, 1974 and section 6 of the Air (Prevention and Control of Pollution) Act, 1981 empowers the Central Pollution Control Board to act as State Pollution Control Board for all the Union Territories of the Union of India.

In March 1991, all its powers and functions of the Central Pollution Control Board (CPCB) for the Union Territory of Delhi were transferred to a committee of officials as per the specification of the Government of India. This committee of officials constituted by the Central Pollution Control Board is called as the Delhi Pollution Control Committee (DPCC).

What is the validity of Delhi Pollution Control Certificate or the DPCC Certificate?

The validity of the DPCC Registration, for white category of business is 7 years and the validity of Consent to Establish (CTE) certificate, for green and orange business category, is generally one year or till the construction of the factory premises and installation of the machinery. The validity of the Consent to Operate (CTO) certificate is up to ten years for green category and up to five years for orange category of business activities.

OCMMS means Online Consent Management and Monitoring System of the DPCC, wherein the applications for DPCC license or the certificate are submitted and the certificate is issued. CMC is the Consent Management Cell of the DPCC, wherein the Delhi Region is divided into various zones, each with a separate Consent Management Cell.

What is the procedure for online application for Delhi Pollution Control Certificate?

The applicant is required to submit initial details and create a login id and password on the website of Delhi Pollution Control Committee, After this, the applicant needs to submit all the details of the business, Company name, address of business, nature of work, usage and wastage of water, any kind of emission, details of the DG Set, Boiler, Oven etc. After that the fee is deposited online. The Registration for White category of business is issued and for green and orange category, the application is automatically forwarded to the concerned officer of the Delhi Pollution Control Committee. The concerned officer may visit the applicant’s factory premises or the hotel, restaurant, hospital etc and issue some clarifications. Once the clarification raised by the concerned authority are suitably answered, the Certificate is issued.

What is the cost of Delhi Pollution Certificate?

The one-time Government fee for white category of business activity is Rs.10,000. The Government fee for green and Orange categories depend on a letter issued by the Chartered Accountant, stating the total project cost of the business, the cost it incurred in setting up a business enterprise. For Boiler, Oil and Grease Trap, Effluent Treatment Plant (ETP) or a Sewage Treatment Plant (STP), the laboratory testing fee ranges between Rs.5,000 to Rs.10,000.

Is the business activity allowed in an industrial area only or it can be anywhere in Delhi?

As per the DPCC notification, no business activity can be performed in the residential area. The white category of business, along with the hotels, restaurants and health care establishments can be set up in the commercial areas also. The manufacturing business activities under green and orange categories can only be performed in an Industrial area.

How Can I apply for Delhi Pollution Control Certificate online?

First the creation of DPCC login & password id required. For this, the applicant is required to visit the official website of Delhi Pollution Control Committee. Click the new registration button there. You will be asked to submit your phone number and email id, the OTPs will be sent to both of these. Once the OTP is entered, He/she will get an email from DPCC, confirming the new login generated along with onetime password. The applicant should login again to DPCC website, with the login credentials earlier mailed to the applicant, for the complete DPCC application submission and online payment of Govt fee.

How long does it take to receive the Delhi Pollution Control Certificate after applying online?

Once the Government fee is paid online, the application is forwarded to the official of the concerned Consent Management Cell (CMC). The official would review the application and issue an online document deficiency letter, if any document is missing. Also, the concerned DPCC official will also conduct a site inspection. All this process takes 60 – 90 days, after which the DPCC Consent to Establish (CTE) or Consent to Operate (CTO) certificate is generated online and is also mailed to the applicant.

Is it mandatory to obtain a Delhi Pollution Control Certificate for all industrial activities in Delhi?

As per DPCC guidelines, every business activity should get registered with the Delhi Pollution Control Committee, prior to the setting up of any business. Be it a restaurant, hotel, healthcare establishment or any manufacturing activity.

Can a business operate without a Delhi Pollution Control Certificate?

Any business entity engaged in manufacturing activity, hotel, restaurant or a health care establish is required to apply for and get DPCC Certificate. No business should operate in Delhi without the DPCC certificate.

What are the consequences of operating without a Delhi Pollution Control Certificate?

If any business entity is found operating in Delhi without the Pollution Control Certificate, the concerned DPCC official may issue a Show Cause notice to the entity, asking for reasons for not getting registered with the DPCC. If the reasons so submitted are found to be correct then the official may give more time for DPCC registration. If no plausible reason is found in response to the show cause notice, then the official may ask the business owner to close the business.

Can I transfer my Delhi Pollution Control Certificate to another location within Delhi?

The DPCC Certificate is issued for an address and it is non-transferrable. If the business address is changed, then the applicant is required to apply as a new application.

What are the steps involved in renewing a Delhi Pollution Control Certificate?

Once the DPCC certificate is issued, the validity of the certificate is mentioned in the certificate only. The license holder is required to apply for renewal of the same one month prior to the expiry of the existing validity of the DPCC certificate.
