  • The Parliament of India enacted a law called Factories Act, 1948 on 23rd September 1948, which came into effect on 1st April 1949. As per the provisions of this Act, the State Governments were empowered to make their own legislations regarding the registration, approval and licensing of factories.
  • The State Governments were to establish mechanisms under which a Government Department was to set up an office consisting of Factory Inspectors and Chief Factory Inspector who would regulate the setting of new factories and compliance requirements of existing factories as per Sec 6 of Factories Act (Approval, Licensing and Registration of Factories).
     

Any business activity involving manufacturing of articles comes under the definition of a factory and the business owner require a factory license just as a Hotel or a restaurant need a Health Trade License and a trader needs a trader license. All these licenses are issued by the respective Municipal Corporation of the area. 

The applicant is required to apply online on the official website of the Municipal Corporation. Once the documents submitted and the Govt. fee is deposited online, the application is submitted. The designated Factory Inspector of the area would perform a site visit and inspection of the factory premises. After the queries raised by the Factory Inspector are answered in a satisfactory manner, the Factory License is issued and emailed to the applicant. 

The expenses for the Factory License application consist of Government fee and the consultant charges, if hired. The Government Fee depends on the factory floor area in sq. feet or the amount of electricity consumed by the said factory.

  • The factory owner is to ensure the health, safety and welfare of all the workers during the time they are working in the factory premises
  • The occupier has to ensure the provisions and maintenance of plant and machinery so that it is safe to operate without risks to health
  • He/she has to make proper arrangements in the factory for ensuring safety during the regular use, handling, storage and transport of articles and substances
  • He has to ensure that proper information, instruction, training and supervision is provided to the workers which may be deemed as necessary to ensure the health and safety of all workers

Introduction

As per section 6 of the Factories act 1948, The employer has to obtain a license to run the factory and also to get it renewed for One year or any further period of up to Ten Years. The occupier shall file an application before the Chief Inspector of Concerned State Government (SG). After verification of the Site plan and other documents, the chief inspector will grant the factory license.
