Plastic EPR Registration

Introduction

  • The Plastic Waste Management (PWM) Rules, 2016 was notified by the Ministry of Environment, Forest, and Climate Change (MoEFCC), On March 18, 2016, On April 8, 2016, the Ministry also published the Solid Waste Management Rules, 2016. Because plastic waste is classified as solid waste, both rules apply to the management of plastic waste in the country.
  • The Plastic Waste Management Rules, 2016, require plastic waste generators to take steps to reduce plastic waste generation, not litter plastic waste, ensure segregated waste storage at the source, and pass over sorted waste to local bodies or entities that have been authorised by local bodies Local governments, gram panchayats, waste generators, retailers, and street sellers all have roles and obligations in the management of plastic waste, according to the rules.
  • According to the PWM Rules, the PIBOs who introduce the products into the market bear Extended Producers Responsibility (EPR) for the management of plastic waste packaging. They must collaborate with local governments to develop a system for managing the plastic waste generated by their products. Local governments are responsible for establishing the PWM system, with assistance from producers and brand owners.
  • Furthermore, PIBOs operating in more than two states must register with the CPCB, while those operating in one or two states must register with the relevant SPCB/PCC. To obtain registration, an EPR Action Plan for PWM must be submitted.

How to register for CPCB Plastic EPR?

1.  Assessment of Plastic Packaging Categories (I–IV)
Identification of plastic types used (rigid, flexible, MLP, compostable etc.) and mapping annual quantities. 

2.  EPR Target Calculation
Calculation of year-wise EPR obligations based on past sales/import projections and mandated guidelines. 

3.  Preparation of EPR Action Plan
Drafting action plan covering collection mechanism, recycling tie-ups, targets, and compliance pathway. 

4.  Document Compilation & Portal Account Creation
Registration on the CPCB EPR Portal, uploading company information, IDs, and packaging data. 

5.  Application Submission & Query Resolution
Filing the application with CPCB, responding to clarifications, and updating any required technical details. 

6.  Grant of EPR Authorization
Once approved, CPCB issues a valid EPR Registration Certificate with obligations and reporting requirements. 

7.  Post-Approval Compliance Support
Quarterly/annual reports, recycling certificates, EPR fulfilment, and log maintenance.

The Govt. fee for EPR Registration is:

  • --  Rs.10,000 for upto 1000 Tonnes Per Annum (TPA) of plastic waste generation
  • --  Rs.20,000 for 1000 to 10,000 TPA of plastic waste generation
  • --  Rs.50,000 for more than 10,000 TPA of plastic waste generation 

PWM Rules impose requirement of Extended Producer Responsibility (EPR)- Plastic on the producer, importer, and brand owners of plastic materials for plastic packaging waste collection and recycling. EPR will apply to both pre- and post-consumer plastic packaging waste.

Producer means a person who manufactures or imports multilayered packaging, carry bags, plastic sheets or similar materials, and includes industries or individuals which use plastic sheets or similar materials or covers made of plastic sheets or multilayered packaging, for packaging or wrapping their products.

As the PIBOs require Plastic EPR Registration from CPCB, the plastic waste recycler entities need to register with the CPCB to get Plastic Waste Processor (PWP) Registration. Only the recyclers registered as PWPs with the CPCB are eligible to issue plastic recycling Registration for the recycling targets or annual compliance submissions of entites holding Plastic EPR Registration.  

Every business entity engaged in the business activity of importing, manufacturing or using plastic for with their own branded products, except small & medium enterprises of brand owners & importers, are required to get Plastic EPR Registration. The PIBOs, producers of plastic items, importers of plastic products and business entites which are not producing plastic products but using plastic for their own manufactured products, such as for packaging of products, need to have plastic epr certifcate. The three categories of palstic materiels under EPR are Rigid Plastics (Category -I), Flexible Plastics (Category - II), Multi-level packaging (Category - III) & Compostable Plastics (Category - IV).  

The applicant, a producer, importer or brand owner is required to apply online at the CPCB EPR Portal. First the registeration is done by generating the login id & Password on the portal. Once password is created and emailed to the applicant's email id, the same can be used to login into the portal and required documents are submitted. The Govt. fee for EPR Certificate is Rs.10,000.
