Any individual or business entity is required to have a Rajasthan Pollution Board Registration or Rajasthan Pollution Board license who are engaged in manufacturing activity, hotels, restaurants, hospitals or clinics in Punjab to make sure that the particular activity is compliant with the Rajasthan Pollution Control Board and that the air or water pollution by the business activity is within the limits set by the Rajasthan Pollution Control Board.

The consent certificate from the Rajasthan Pollution Control Committee is also known as a Pollution Board license or Pollution Department NOC. For the White Category of Business, the Pollution certificate is called the Pollution Board Registration while For the Green and Amber Category of Business activity, the Certificate is called the Punjab Pollution Board Consent. There are 2 types of consent issued by the Punjab Pollution Board. For establishing a business, the Consent to Establish (CTE) certificate is issued, i.e. construction of the factory premises, installation of the machinery etc while after the Consent to Establish (CTE) certificate, the Consent to Operate (CTO) certificate is issued when the business becomes fully operational.

For the white category of business, the validity of the Rajasthan Pollution Board Registration is 7 years and for the green and amber business category, the validity of the Consent to Establish (CTE) certificate, is generally one year or till the construction of the factory premises and installation of the machinery.  For the green category, the validity of the Consent to Operate (CTO) certificate is scrutinized and for the amber category of business activities, it is up to five years.

The Requirement of the Rajasthan Pollution Control Board certificate is mainly for any individual or a business entity who is engaged in the manufacturing of articles in factory premises, having hospitals, hotels, restaurants and any other health care establishment, under the jurisdiction of Punjab State. 

The procedure for online application for Rajasthan Pollution Control Certificate includes:

  • Submission of initial details and creating a login id and password on the website of the Rajasthan Pollution Control Board. 
  • Applicant must submit all the details of the business, Company name, address of the business, nature of work, usage, and wastage of water, any kind of emission, details of the DG Set, Boiler, Oven, etc. 
  • After that, the fee is deposited online. 
  • The Registration for the White category of business is issued and the application is automatically forwarded for a green and orange category, to the concerned officer of the Rajasthan Pollution Control Board. The concerned officer may visit the applicant’s factory premises or the hotel, restaurant, hospital, etc, and issue some clarifications. The Certificate is issued, once the clarification raised by the concerned authority is suitably answered.

For the green and Orange categories, the Government fee depends on a letter issued by the Chartered Accountant, stating the total project cost of the business, and the cost incurred in setting up a business enterprise. The laboratory testing fee ranges between Rs.5,000 to Rs.10,000 for Boiler, Oil and Grease Trap, Effluent Treatment Plant (ETP) or Sewage Treatment Plant (STP).

Introduction

On February 7, 1975, the Rajasthan Pollution Control Board (RPCB) was established under section 4 of the Water (Prevention and Control of Pollution) Act, 1974, with the goals of preventing, controlling, and maintaining or restoring water wholesomeness. Later, under the requirements of the Air (Prevention and Control of Pollution) Act, 1981, it was also tasked with the responsibility of air pollution prevention, control, and abatement. The Water (Prevention and Control of Pollution) Cess Act of 1977 was enacted to provide financial independence to the State Board. 

The Rajasthan State Pollution Control Board has been given powers under this legislation to collect Cess on the basis of water consumed by industries and other factors. The passage of the Environment (Protection) Act in 1986 broadened the Board's mandate even further. Because this Act is an umbrella law, different rules for dealing with difficulties in various industries have been created under it. The State Board is in charge of enforcing the laws established under the Environment Protection Act of 1986.

Functions of the Rajasthan State Pollution Control Board NOC

Procedure for Acquiring Rajasthan State Pollution Control Board ( RSPCB) Certification 

The Rajasthan State Pollution Control Board (RSPCB) will issue Consent to establish within a stipulated time, and the validity period of the Consent will be 3 to 5 years depending upon the industry category. If the project proponent requires renewal of the Consent, a request must be made at least four months before the expiry of validity.

  • Application and Document Submission

The applicant must fill out an online application for Consent on the MIS page of the Board and deposit the requisite fee. After that, duly-certified documents must be uploaded as per the checklist provided by the RSPCB.

  • Reviewing the application

Once submitted, the application and attached documents are scrutinised by both CTE and CTO, depending on the application stage.

  • Inspection

A site inspection will be scheduled if the Board is satisfied with the application. The inspecting officer visits the site and prepares an inspection report. Field inspection is conducted when the manufacturer is filing for a Certificate to operate.

  • Grant of Certificate

Decision on granting or rejecting the will be taken in stipulated time subject to submission of complete application and a satisfactory inspection report. CTO will be issued online, and the applicant will be intimated to download the CTO from the website
